The court ruled against former pinup model, Anna Nicole Smith, who married the Texan billionaire, J. Howard Marshall. Smith battled with Marshall’s son for a decade over the estate.
The court ruled, “Her estate is not entitled to $300 million.” According to CNN.com, Smith claimed that the fortune was a gift from her oil tycoon husband.
The Ninth U.S. Circuit Court of Appeals backed a Houston jury’s verdict that, “J. Howard Marshall was mentally fit and under no undue pressure when he wrote a will leaving nearly all his $1.6 billion estate to his son,” according to guardian.com
The court battle outlived the two. E. Pierce Marshall died in 2006, and Smith died in 2007 from “acute combined drug intoxication,” according to CNN.com.
Smith claimed that Marshall’s son “used fraud and undue influence” to get his father to exclude her out of the will.
Kent Richland, a lawyer for Smith’s estate, vowed to appeal against the most recent ruling on different issues than it first considered. “It really is a unique decision,” Richland said, “We have to take it farther,” the guardian.com reports
If the ruling is upheld this could mean bad news for Larry Birkhead and their daughter Dannielynn, who was named heir of Smith’s fortune, The Guardian reported.
